It would be a big enough thing that it could change course and precedent, but thankfully I don't think there's any chance of it happening. I don't think Sony or Microsoft would drag each other to court over it, so I'm thinking they would rather set up sort of a "gentlemen's agreement" over not doing emulation of each other's systems, but I could see for example Nintendo going mad and dragging companies to court over it. While this is true with the current precedent, I could definitely see a new precedent being set if one of the big ones did that now. Microsoft could sell the Xbox Series consoles with Playstation backwards compatibility when inserting the disks, and as long as it doesn't use a official Sony BIOS file, or copyrighted art, it would be completely legit. When modded OG Xboxs were becoming a huge thing, and lots of people were getting busted for selling them, they were getting busted for selling illegal copies of the games contained in them, not so much the consoles themselves. Selling unauthorized back ups is highly illegal. Backing up existing games you own seems to be pretty safe, although I am not a legal expert on that, since you have conflicting laws and court cases like the Copyright Act of 1976, Universal Studios vs Sony, and the DCMA, all applying to new technology. Downloading what you do not own is definitely illegal, as is knowingly buying an unauthorized backup or"repro". Official BIOS files are copyrighted and illegal, and downloading ROMs/ISOs are in a grey area if you don't own the game.
